Project Terms and Conditions

General

I will always do my best to meet your needs and your goals, but it helps to have a few simple things written down so that we both know what is what, who does what, and what happens if something goes wrong. You will not find complicated legal language here. These terms protect both of us, now and later.

What we both agree to do

You agree to provide everything I need to complete the project, including text, images and other information, when I need it and in the format I ask for. You agree to review my work, give feedback and sign off in a timely manner. Deadlines work both ways: you are bound by the dates we set together, and so am I. I have the experience and the ability to carry out the services you need, and I will do so professionally and on time. I cannot be responsible for a missed launch date or deadline if materials arrived late or work was not approved on time. I will keep any information you give me confidential.

Design

I will create designs for the look and feel, layout and functionality of your project. An offer includes two to three design concepts leading to one main design, plus up to two rounds of revisions. If you are not happy with the designs at that stage, you pay in full for the work produced up to that point, and you can either end the project or commission further revisions at the hourly rate below.

Changes and additional work

The fees in an offer are based on the scope described in it. If you change your mind or add deliverables, that is not a problem. Work outside the agreed scope, including revisions beyond the two included rounds, is charged at 150 € per hour plus VAT, after you have approved my estimate for it. I may ask you to put requests in writing so we can keep track of changes.

Text content

I am not responsible for writing or entering text unless the offer says so. I am happy to help: copywriting and content entry are charged at 150 € per hour plus VAT.

Photographs

You supply photographs in digital form. If you choose to buy stock photographs, I can suggest sources. Time spent searching for suitable images is charged at 150 € per hour plus VAT, plus the cost of the images.

Copyright

I guarantee that all text, graphics, photos, designs and other artwork I provide under this agreement are my original work, or that I have the rights to use them. You guarantee that any material you provide for the project is owned by you, or that you have permission to use it. When I receive your final payment, copyright is assigned as follows: you own the graphics and other visual elements I create for you in this project. I will give you a copy of all files after final payment, and you should store them safely, as I am not required to keep them or to provide the native source files used to make them. You also own the text, photographs and other data you provided, unless someone else owns them. I own the design and license it to you for use on your own communication materials, free of charge and without time limit. I reserve the right to show the completed project in my portfolio and to write about it.

Payments

All amounts are net, excluding VAT. Unless the offer says otherwise, work is invoiced on delivery and payable within 14 days. For larger projects, 50 percent is invoiced on approval of the offer and 50 percent on delivery. As a small business I depend on prompt payment, so please keep to the agreed schedule.

Cancellation

If the project is cancelled, Room Six keeps the copyright and the original artwork, and you pay for the work completed and the expenses incurred up to that point. For hourly work, that is at least the hours already billed plus a flat fee of 150 € plus VAT, or 50 percent of the remaining estimated hours, whichever is greater. For fixed fees, the share of the fee that corresponds to the work completed. Once a project is finished, the full fee is due whether or not it has been delivered.

Validity

Every offer is valid for 30 days.
